The privacy of visitors to our websites is very important to Obayashi. PRIVACY OF MINORS

Obayashi does not deliberately collect, or attempt to collect, personal information from minors known to be under the age of thirteen (13). California Privacy Notice for California Residents

This California Privacy Notice for California Residents supplements Obayashi’s Privacy Policy and the information contained within and applies solely to California Residents in order to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other applicable California privacy laws and regulations.

Information Obayashi Collects

Over the past twelve months, Obayashi has collected the following categories of personal information as defined by California Civil Code section 1798.140(o)(1):

(A) Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.

(B) Any categories of personal information described in subdivision (e) of Section 1798.80.

Section 1798.80 defines “personal information” as the following, which may overlap with other information contained within other sections of this disclosure: “any information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, his or her name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.”

“Personal information” does not include publicly available information that is lawfully made available to the general public from federal, state, or local government records.

California includes the following categories as “protected classifications”: age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, and genetic information (including familial genetic information).

(D) Commercial information, including records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

(E) Biometric information.

(F) Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement.

(G) Geolocation data.

(H) Audio, electronic, visual, thermal, olfactory, or similar information.

(I) Professional or employment-related information.

(J) Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99).

(K) Inferences drawn from any of the information identified in this subdivision to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Obayashi obtains these categories of information from information that individuals submit to Obayashi directly, and from third parties, including other businesses, other websites, current and/or former employers, background check providers. Obayashi also collects information when users interact with our website and/or use our services.

Obayashi’s Use of Personal Information

Personal information and/or aggregate data collected by Obayashi may be used for the following:

Your Rights Under the CCPA

The CCPA provides California residents with rights regarding their personal information. This section describes the rights provided by the CCPA and how to exercise those rights.

Please note that the CCPA provides that consumers can make a request twice within a 12-month period. Obayashi will verify your identity in order to process your request. Obayashi will respond to your request within the required 45 days of receiving the request.

Consumer Request for Personal Information Held by Obayashi

The CCPA provides that California residents have the right to request the following information from Obayashi:

The categories of personal information that Obayashi has collected about you, and the categories of sources from which Obayashi collected the personal information.
The categories of your personal information that Obayashi has sold and the categories of third parties to whom the personal information was sold, by category or categories of personal information, for each third party to whom the personal information was sold.
The categories of your personal information that Obayashi disclosed for a business purpose, and the categories of third parties to whom the personal information was disclosed for a business purpose, by category or categories of personal information, for each third party to whom the personal information was disclosed for a business purpose.

Consumer Request that Obayashi Delete Their Personal Information

The CCPA provides that California residents can request that Obayashi delete any of their personal information held by Obayashi. However, the CCPA provides that Obayashi may retain personal information if one or more of the following exceptions apply to that piece of personal information:

Obayashi must maintain the consumer’s personal information in order to complete the transaction for which the personal information was collected, provide a good or service requested by the consumer, or reasonably anticipated within the context of Obayashi’s ongoing business relationship with the consumer, or otherwise perform a contract between Obayashi and the consumer.
Obayashi must maintain the consumer’s personal information to detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity.
Obayashi must maintain the consumer’s personal information to debug to identify and repair errors that impair existing intended functionality.
Obayashi must maintain the consumer’s personal information to exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
Obayashi must maintain the consumer’s personal information to comply with the California Electronic Communications Privacy Act pursuant to Chapter 3.6 (commencing with Section 1546) of Title 12 of Part 2 of the Penal Code.
Obayashi must maintain the consumer’s personal information to engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when Obayashi’s deletion of the information is likely to render impossible or seriously impair the achievement of such research, if the consumer has provided informed consent.
Obayashi must maintain the consumer’s personal information to enable solely internal uses that are reasonably aligned with the expectations of the consumer based on the consumer’s relationship with Obayashi. Obayashi must maintain the consumer’s information to comply with a legal obligation.
Obayashi must maintain the consumer’s information to otherwise use it, internally, in a lawful manner that is compatible with the context in which the consumer provided the information.

Obayashi Will Not Discriminate Against You for Exercising CCPA Rights

The CCPA prohibits businesses from discriminating against California residents who exercise one or more rights under the CCPA, including, but not limited to:

Denying goods or services to you.
Charging you different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties.
Providing a different level or quality of goods or services to you.
Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.
